Terms of Service

Effective: October 14, 2026

Last updated: October 6, 2026

Until October 14, 2026, the previous version of these Terms (effective September 25, 2026) applies.

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Flynn McConneloug (“NoBrainer,” “we,” “us,” or “our”) governing your access to and use of the NoBrainer mobile application and website (collectively, the “Service”). By downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. Description of Service

NoBrainer is a productivity app for students. The free plan (the “Free plan”) brings your school’s calendar feed, Google Calendar and Google Tasks, and Apple Calendar and Reminders into one place, lets you add and edit your own events and reminders, and lets you see when friends are free. A paid subscription, NoBrainer Pro (“Pro”), adds features that use artificial intelligence to watch your schedule for you: catches (notifications before a deadline slips), a morning brief, an AI chat assistant, and automations. Pro’s AI features process your data and can create events, set reminders, and perform other actions on your behalf when you ask (Section 6). The Free plan does not use AI.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 You must create an account using Sign in with Apple to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 You agree to: (a) provide accurate and complete information during registration; (b) promptly notify us of any unauthorized use of your account; and (c) not create more than one account or share your account with others.

3.3 We reserve the right to suspend or terminate your account if we reasonably believe it has been compromised or is being used in violation of these Terms.

4. Third-Party Integrations and Permissions

4.1 The Service allows you to connect third-party accounts and data, including Google (Calendar, Tasks), Apple Calendar, Apple Reminders, and your school’s calendar feed (such as Canvas or Blackbaud). By connecting these services, you authorize NoBrainer to access and process data from those services as described in our Privacy Policy.

4.2 When you save, check off, or delete an event, reminder, or task in NoBrainer, or ask Siri to add an event or reminder with NoBrainer, you authorize NoBrainer to make that change in the connected calendar or list.

4.3 You represent that you have the right to grant NoBrainer access to your third-party accounts and that doing so does not violate any agreement between you and the third-party service provider.

4.4 Third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services, and your use of such services is at your own risk.

5. The Free Plan, NoBrainer Pro, and Billing

5.1 Free plan. The Free plan costs nothing and has no time limit. It includes the features described in Section 1 that do not use AI. We may change what the Free plan includes, as described in Section 16.5.

5.2 NoBrainer Pro. Pro is an auto-renewing subscription, offered monthly at $6.99 or yearly at $59.99 (US prices; the App Store shows the price in your local currency, and tax may apply). It includes everything in the Free plan plus the AI features described in Section 1.

5.3 Free trial. Eligible new subscribers get a 14-day free trial of Pro. Unless you cancel at least 24 hours before the trial ends, the subscription you chose starts when the trial ends and you are charged then. If you buy a subscription during a free trial, any unused part of the trial ends.

5.4 Billing and renewal. Payment is charged to your Apple ID account. Your subscription renews automatically at the end of each period, monthly or yearly, unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the current period ends.

5.5 Cancelling. You can manage or cancel your subscription at any time in your Apple ID settings (on iPhone: Settings, then your name, then Subscriptions). Cancelling stops the next renewal, and Pro stays on until the end of the period you have paid for. If you cancel during a free trial, Pro stays on until the trial ends, and you are not charged as long as you cancel at least 24 hours before it ends (Section 5.3). Deleting the app or your NoBrainer account does not cancel your subscription.

5.6 Refunds. Apple handles all payments, so refunds are handled by Apple under its policies, and we cannot issue them ourselves. You can request a refund at reportaproblem.apple.com.

5.7 When Pro ends. When a free trial or subscription ends without being renewed, your account moves to the Free plan. Your calendars, Friends, and the events and reminders you add keep working, and nothing in your account is deleted. Pro features stop until you subscribe again.

5.8 Price changes. We may change Pro’s price. Apple tells subscribers before a price change affects them and, where its rules require, asks for their consent first. A new price applies only from a renewal after that notice.

6. AI-Generated Content and Actions (Pro)

6.1 Pro’s AI features use OpenAI’s models, with Anthropic’s Claude as a fallback, to generate responses and suggestions and to carry out actions on your behalf. The Service sends your data to these providers only if you have Pro and have allowed AI processing in the app, as described in our Privacy Policy. AI-generated content is provided for informational and convenience purposes only.

6.2 No Guarantee of Accuracy. AI-generated responses may contain errors, inaccuracies, or incomplete information. You acknowledge that AI outputs should not be relied upon as the sole basis for important decisions, and you are solely responsible for verifying the accuracy of any information provided by the Service.

6.3 Actions on Your Behalf. When you ask the AI assistant to create, change, or delete calendar events or reminders, or to take another action it offers, you authorize NoBrainer to carry out that action using your connected accounts. You are responsible for reviewing and confirming the results of any actions taken.

6.4 We are not liable for any consequences arising from actions taken based on AI-generated content or actions executed by the AI assistant, including but not limited to missed appointments, incorrect scheduling, or lost data.

6.5 Catches and other reminders are a convenience, not a guarantee. NoBrainer may miss a deadline, send a reminder late, or not send one at all, for example when a calendar feed is wrong or unavailable. You remain responsible for your own deadlines.

7. Friends

7.1 Friends lets you share when you are busy or free with people you choose. To use it, you choose a username and may add a display name and a profile photo.

7.2 Usernames and display names. Do not use a username or display name that impersonates another person, school, or organization, or that is offensive, hateful, harassing, or sexual. We may remove or change a username or display name that breaks this rule.

7.3 Profile photos. Only upload a photo you have the right to use. Do not upload nudity, sexual content, graphic violence, hate symbols, or a photo of someone else without their permission. You keep ownership of your photo and give us permission to store it and show it to the people described in our Privacy Policy, only to run Friends.

7.4 Invite links. Anyone who opens your invite link can see your display name, username, and profile photo and send you a friend request, which you can accept or decline. Only share invite links with people you want to hear from.

7.5 Blocking and reporting. You can remove or block a friend at any time, and report an account that breaks these Terms. We review reports within 24 hours.

7.6 Our rights. We may remove usernames, display names, or photos, and suspend or terminate accounts, that break these Terms or put other users at risk, with or without notice (see Section 14).

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation;
  • Access or attempt to access another user’s account or data;
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
  • Transmit any malware, viruses, or other malicious code;
  • Use the Service to send unsolicited communications (spam), harass, or abuse any person;
  • Use the Service to generate content that is harmful, threatening, abusive, defamatory, or otherwise objectionable;
  • Use automated means (bots, scrapers, etc.) to access or interact with the Service;
  • Circumvent any security measures or access controls implemented by the Service.

9. Pre-Release (TestFlight) Builds

9.1 From time to time we may offer pre-release versions of the Service through Apple TestFlight for testing and evaluation. Pre-release builds may contain bugs, errors, and incomplete features. This section applies only to those builds, not to the version of the Service distributed through the App Store.

9.2 If you choose to use a pre-release build, you acknowledge and agree that:

  • Pre-release builds may be unstable and may not function as intended;
  • Features may be added, modified, or removed without prior notice;
  • Data loss may occur, and we may need to reset or wipe data associated with pre-release builds;
  • Availability and uptime of pre-release builds are not guaranteed;
  • A pre-release build may differ significantly from the version available on the App Store.

9.3 We encourage you to report bugs and provide feedback to help improve the Service.

10. Intellectual Property

10.1 The Service, including its design, code, visual elements, branding, trademarks, and all related intellectual property, is and shall remain the exclusive property of Flynn McConneloug. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

10.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

10.3 You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, unless applicable law expressly permits such activities notwithstanding this limitation.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOBRAINER, ITS OWNER, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SERVICE;
  • AI-GENERATED CONTENT, RESPONSES, OR ACTIONS, INCLUDING INACCURATE OR ERRONEOUS INFORMATION;
  • MISSED REMINDERS, INCORRECT SCHEDULING, DATA LOSS, OR SERVICE INTERRUPTIONS;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;
  • ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless NoBrainer and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law or regulation.

14. Termination

14.1 We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Service or other users.

14.2 You may stop using the Service at any time by deleting the app from your device. To delete your account and its data, open the app and go to Settings, then Delete Account. Deleting your account does not cancel a subscription; cancel it in your Apple ID settings (Section 5.5). If you can’t get into the app, email us at johnflynn850@gmail.com and we will delete your account for you.

14.3 Upon termination, your right to use the Service will immediately cease. Sections 6.2, 6.4, 6.5, 10, 11, 12, 13, 15, 16, and 17 shall survive termination.

15. Governing Law and Dispute Resolution

15.1 These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law principles.

15.2 Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of such courts.

16. General Provisions

16.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and NoBrainer regarding the Service and supersede all prior agreements and understandings.

16.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Modifications. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or via email at least 7 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.

17. Apple App Store

If you got NoBrainer from Apple’s App Store, you and we also agree to the following:

  • These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Your license to use the app (Section 10.2) covers only Apple devices that you own or control, as the App Store’s Usage Rules allow.
  • Apple has no duty to maintain or support the app.
  • If the app fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the fullest extent the law allows, Apple has no other warranty duty for the app.
  • We, not Apple, are responsible for handling any claim about the app or your use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, claims under consumer protection or privacy laws, and claims that the app infringes someone else’s intellectual property.
  • You confirm that you are not located in a country that is subject to a U.S. government embargo or that the U.S. government has designated as supporting terrorism, and that you are not on any U.S. government list of prohibited or restricted parties.
  • When you use the app, you must also follow the terms of any other service you use with it, such as your wireless data plan.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you.

Send questions, complaints, or claims about the app to us, not Apple (Section 18).
